Terms & conditions

These terms apply to all coaching and training from Second Wind Collective (Dan McCaffrey, ABN 95 578 157 985). By paying for a service, or by starting a subscription at checkout, you agree to them. If anything here is unclear, email dan@secondwindcollective.fit before you sign up.
1. Services and prices
Current services and prices are published on the main page. Online coaching and race preparation are billed in euro. In-person training in Melbourne is billed in Australian dollars. GST is not charged. Prices may change with reasonable notice; any change applies from your next billing period, never to a period you have already paid for.
2. Payments
- All coaching and sessions are paid in advance unless agreed otherwise in writing.
- Monthly online coaching and weekly in-person training are billed automatically on a repeating subscription through Stripe, on the same date each period, until you cancel.
- Payments are processed by Stripe. Your card details are held by Stripe, never by me. Stripe's own terms apply to the payment itself.
- Blocks paid up front (12-week coaching, race preparation, session packs) are single payments, not subscriptions.
3. Online coaching: minimum term and cancelling
- Monthly online coaching has a 3-month minimum, counted from your first payment. After that it rolls month to month.
- The minimum term applies once, at the start. Moving from a pre-paid block onto a monthly subscription does not start a new minimum term.
- To cancel after the minimum term, tell me by message or email at least 7 days before your next billing date. Coaching then continues to the end of the period you have paid for and stops.
- Cancel with less than 7 days' notice and the next payment stands; coaching runs to the end of that period and does not renew again.
- The 12-week block is paid up front and covers the same 12 weeks as the minimum term. It is not refundable once coaching has started.
4. Pausing coaching
- Life happens. You can pause monthly coaching once in any 12 months for up to 4 weeks. Ask at least 7 days before your next billing date.
- While paused, billing stops and so does programming and app access. Your minimum term extends by the length of the pause.
- Longer pauses for injury, illness or something serious are at my discretion, and I will usually say yes.
- A pause is not a cancellation. If you do not come back on the agreed date, billing restarts unless you have cancelled under section 3.
5. Race preparation
Race preparation is a fixed block (12 or 16 weeks) paid up front, ending at your race. If your race is cancelled or moved, we will adjust the plan to the new date or a new event. Race blocks cannot be paused, because the plan is built backwards from a date.
6. In-person training in Melbourne
- Sessions run at Hustle Wellness Club, Balaclava. You do not need a gym membership. Sessions are 45 minutes.
- Weekly training is billed weekly in advance. Your regular time slot is held for you while you keep booking and paying.
- Cancelling or rescheduling: give at least 12 hours' notice. With that notice I will reschedule you within the same week where I have a slot free.
- Less than 12 hours' notice, or not showing up: the session is charged in full. It is not rescheduled, credited or refunded. I may waive this for a genuine emergency or illness, but that is a courtesy rather than something you can count on.
- Sessions start and finish at the booked time. If you arrive late, the session still ends on time and is charged in full.
- Sessions are for the week they are billed for. A session you do not use that week does not roll over, unless I am the one who cancelled it.
- If I cancel a session, you get it back: rescheduled that week if possible, otherwise credited to the following week.
- Repeated late cancellations may mean you lose your regular time slot.
- To stop weekly training, tell me at least 7 days before your next billing date. With less notice, the next week stands.
- Pre-paid session packs must be used within 12 weeks of purchase. Extensions are at my discretion.
- Sessions are for you and cannot be transferred to someone else without my agreement.
7. Refunds
- Payments are not refundable for a change of mind. That includes unused pre-paid sessions and the unused part of a block you have started.
- If I cannot deliver what you paid for — I stop trading, or I cannot coach you for a long period — I refund the unused part of what you paid, pro rata.
- If something has gone wrong on my side, email me and we will sort it out fairly.
- Nothing here limits your rights under the Australian Consumer Law, or your consumer rights where you live.
8. Changing your mind: 14-day cooling-off
If you are a consumer in the EU or the UK, you have 14 days from signing up to change your mind about a service bought online, and I will not argue with that. Coaching normally starts straight away, which means you are asking me to begin during those 14 days. If you then cancel within the 14 days, I will refund you minus a fair amount for what has already been delivered — the programme written, the calls had, the weeks coached. Once the full service has been delivered inside that window, the right ends.
9. Failed payments and disputes
- If a payment fails, Stripe will retry it. If it is still unpaid after 7 days, programming and app access are paused until it clears.
- A failed or late payment does not end your minimum term, and it is not a cancellation. Cancelling works the way section 3 describes.
- If you think a payment is wrong, email me first. I fix genuine errors quickly and without fuss.
- Raising a dispute with your bank before talking to me costs us both time and fees, and I may end coaching if it happens without reason.
10. If I end coaching
I may end coaching if you breach these terms, if payments stop, or if the working relationship is not right for either of us. If I end it for any reason other than your conduct or non-payment, I refund the unused part of what you have paid, pro rata. If I end it because of conduct or non-payment, no refund is due.
11. Health and safety
- Tell me about any medical condition, injury, medication or limitation before we start, and let me know if anything changes.
- Exercise carries some risk. You take part voluntarily and are responsible for getting medical clearance where needed.
- Coaching is not medical advice, diagnosis or treatment. Nutrition guidance is general and educational; it is not a clinical diet for a medical condition.
- Second Wind Collective is not responsible for injury caused by a condition you did not disclose, or by training outside the plan.
- Stop and tell me if something hurts. Do not train through pain because a plan says to.
12. Results
Results depend on your effort, consistency, nutrition, sleep and life outside training. I will give you the best plan and support I can, but I cannot guarantee a specific result. Client results shown on this site are real, and individual.
13. Your programme and materials
The programmes, plans, guides, check-in documents, video feedback and written reviews I make for you are yours to use for your own training, and they stay my intellectual property. Please do not share, publish, resell or coach other people from them.
14. Apps and access
- Coaching runs through Everfit, and some clients log their lifting in Second Wind Lift. You may also connect Apple Health or MyFitnessPal. Those are third-party apps with their own terms, and I cannot control their availability.
- Your account, programming and history stay available while coaching is active. When coaching ends or is paused, access ends with it.
- Keep your own copy of anything you want to hold on to. If you ask before you finish, I will export your programme and check-in history for you.
15. Photos, results and testimonials
Your progress photos, numbers and check-ins are private. I only use a photo, a result or something you have written publicly if you have given me permission for that specific use, and you can withdraw permission at any time — tell me and I will take it down.
16. Conduct
Be respectful to me, other members and staff at Hustle Wellness Club, and the equipment. I may end coaching if this is not the case.
17. Age
Coaching is for adults. If you are 16 or 17, I can coach you only with the written consent of a parent or guardian, who accepts these terms with you. I do not coach under-16s.
18. Liability
To the extent the law allows, and except where the Australian Consumer Law says otherwise, my liability for any claim connected to these services is limited to the amount you paid me in the 3 months before the claim. I am not liable for indirect losses, such as missed events or lost earnings.
19. Changes to these terms
I may update these terms. The current version always lives on this page with the date it was last updated. Changes apply from your next billing period, and I will tell you about anything significant rather than leaving you to find it.
20. Your information
How I collect and use your information is covered in the privacy policy.
21. Law
These terms are governed by the law of Victoria, Australia. That does not take away the consumer rights you have where you live.
